The Department of Justice filed papers on April 24 joining a federal lawsuit brought by Elon Musk's AI company xAI seeking to block Colorado's Artificial Intelligence Act from taking effect on June 30. The case — xAI v. Weiser, 1:26-cv-01515, U.S. District Court, District of Colorado — marks the first time the federal government has intervened in a lawsuit challenging a state AI regulation.

The DOJ's filing argues that SB 24-205 violates the First and Fourteenth Amendments, characterizing the law's algorithmic fairness requirements as unconstitutional compelled speech and impermissible race-conscious regulation. Assistant Attorney General Harmeet Dhillon stated the law "jeopardises the United States' position as the global AI leader."

The law remains scheduled to take effect June 30. No injunction has been issued. Colorado businesses should continue compliance preparation while monitoring the litigation — courts move slowly, and a ruling before the deadline is not guaranteed.
